Terms of Service

These Terms of Service ("Terms") govern access to and use of getvisitor.info (the "Service"), owned and operated by SimpleRUM ("SimpleRUM", "we", "us"). By creating an account or using the Service, you ("you", "Customer") agree to these Terms.

1. Billing is handled by Polar, not us

Purchases of paid plans are processed by Polar, acting as merchant of record. Polar is the seller for these transactions and is responsible for payment processing, invoicing, and applicable tax collection. Polar's own terms govern the purchase itself. These Terms govern the Service — the API and your account — not the transaction.

2. Accounts and API Keys

• We store only a one-way hash of your API key, never the raw value. A compromise of our systems does not expose a working key.
• The raw key is shown to you once, at the time you create it. If you lose it, we cannot retrieve or restore it for you — you must revoke it and issue a new one from your dashboard.
• If you suspect a key has leaked or been exposed, you are responsible for revoking and reissuing it immediately. We are not liable for unauthorized use of your account that occurs through a key you have not revoked.

3. Acceptable Use

You agree not to:

• Circumvent rate limits, quotas, or domain/origin restrictions on your account;
• Use the Service to identify or target a specific individual without a lawful basis for doing so; or
• Use the Service in violation of applicable law.

Reselling access to the Service, including under your own brand, is permitted.

4. Data You Submit

When you call the Service, you submit an IP address and user-agent (and related request data) belonging to your own end visitors. You are solely responsible for having a lawful basis to submit that data, and for any disclosures you owe those visitors under applicable law (for example, in your own privacy policy). We are not a party to that relationship.

5. Intellectual Property

We own the Service, including its API, software, and documentation. We grant you a limited, non-exclusive license to call the API and to use and embed its output in your own product or service.

6. Service Availability

The Service is provided without an uptime guarantee or SLA. We may modify, suspend, or discontinue any part of the Service, including specific response fields or data sources, at our discretion.

7. Usage Limits

Usage limits, rate limits, and overage handling for your plan are documented in our API documentation. We may update these limits from time to time.

8. Liability

To the extent permitted by law, SimpleRUM is not liable for indirect, incidental, consequential, or punitive damages, including lost profits, revenue, or data, arising from your use of the Service. Our total liability arising out of or relating to these Terms or the Service will not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.

9. Indemnification

You agree to cover our costs, including reasonable legal fees, for third-party claims arising from your violation of these Terms or your misuse of data submitted to the Service.

10. Termination

• You may cancel at any time from your dashboard. The Service continues until the end of your current billing period; no refund is given for the remainder of that period.
• We may suspend or terminate your access for continued or repeated violation of Section 3 (Acceptable Use) after we've notified you of the violation, or for non-payment.
• We may suspend or terminate your access immediately, without prior notice, for a severe violation, such as an attempt to harm the Service or defraud us.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Disputes arising out of or relating to these Terms or the Service are subject to the exclusive jurisdiction of the state and federal courts located in Delaware.

12. Changes to These Terms

We may update these Terms at any time by posting a revised version here with an updated date. Continued use of the Service after a change is posted constitutes acceptance of the revised Terms.
